- Notice of Mortgage Foreclosure Sale
Default having been made in the conditions of a certain mortgage executed and delivered by Henry Chesney, Sr., and Cyntha Ann Chesney, his wife, mortgagors, to Melvin O. Warde, mortgagee, bearing date the 7th day of October, A.D. 1884, and recorded in the office of the Register of Deeds, of Morrison County, State of Minnesota, on the 22nd day of October, A.D. 1884, at 9 o'clock A.M. in Book "H" of mortgage deeds, on pages 498, 499 and 500, to secure the payment of the sum of One Hundred and Twenty-Five Dollars and interest, according to the conditions of two certain promissory notes, therein fully described; which said mortgage and the debt secured thereby, was, on the 10th day of October A.D. 1884, duly sold and assigned by said Melvin O. Ward to Thomas E. Driscoll, by instrument in writing, thereafter on the 22nd day of November A.D. 1884, at 8 o'clock a.m. duly recorded in the office of the register of deeds aforesaid, in book H of mortgages, on pages 520 and 521 and no action or proceeding having been instituted at law or otherwise to recover the debt secured by said mortgage, or any part thereof, had there being due, and is now claimed to be due thereon, at the date of this notice, the sum of sixty nine and 60-100 dollars, and twenty-five dollars attorney's fees stipulated in said mortgage to be paid in case of foreclosure.
Now, therefore, notice is hereby given that by virtue of the power of sale contained in said mortgage and the statute in such case made and provided, the said mortgage will be foreclosed by a sale of the premises described in said mortgage, situate in said Morrison County, to wit The North half of the South west quarter (N 1/2 of sw 1/4) of section No. twenty eight (28) Township No. one hundred and twenty seven (127) of range No. thirty (30), by the sheriff of said county, at public venue, to the highest cas bidder, in the Village of Little Falls of said Morrison county, on
Saturday, the 5th Day of March A.D. 1887
at 1 o'clock in the afternoon of that day, to satisfy said mortgage debt, with the cost and expenses of this foreclosure.
